For every 1 person who has a scratched disk supposedly due to the console there is 100 people who have no problem. These people just dont know how to take care of a console, and probably cant even work their stereo cd player without causing it to eat their cds.
I have played over 100 different games and not one of them have even the slightest scratch on them. These people are just dumb.
my 360 has never ate my disks before, but my friend's copy of halo 2 was scratched (small scratches) beyond being playable. we easily fixed them with some good old toothpaste, so it's not a problem.
My game actually cracked inside the 360. One minute it worked the next it didnt. Checked the disk and there was a barely visible crack. Anyway I think its ridiculous to sue for that amount of money. But then again microsoft is trying to sue everybody themselves.

the 360 does scratch the discs over time...
Even if the XBOX 360 scratches discs on some consoles that weren't abused, moved with the disc inside, etc. it seems to me Microsoft is pretty good about taking care of the problem. I mean, has any other company offered any kind of disc replacment program before?

dude...all game consoles scratch your game discs over time...the optic eye is 90% of the cause...if the belt that rotates the disc slips it bumps the eye therefore scatching the disc and the optic eye...Maybe it was your own carelessness that maybe so called "scratched" your beloved once great game GOW and that Piece of ***** game Madden 07 there was never once a good madden...5 million ur trying to take from microsoft...you know why the discs are scratched cuz u bought a faulty xbox that prolly got damaged during shipping so its not microsofts fault its ur own numb nuts
My friend's Xbox scratched his call of duty disk up really badly. It was in the vertical position and it started making a really loud noise. We turned the xbox off really quick and looked at the disk and there was a PERFECT circle on the disk where it got scraped. The game works still but one level gives an error when you try to play it. So we just cant play that level anymore.

i have a friend and he went thru i think 2-3 Gears of War game causses by the game case the xbox360 game case or bad really i noe it easy but like gears being soo cheap wit the cd it cracks easy............

Its not really about the scratching. It's why the scratching occurs. Simply changing position = dead disc. This shouldn't be an issue at all and it's a horrible defect that Microsoft needs to address regardless of the users responsibility or handling.
I really hope the guy wins because he really knows how it feels to own a faulty device that a certain company says its a very good piece of technology. This proplem wouldnt have happened if Microsoft didnt make a faulty product and went to early into the market. It gose to show you how patience is a virtue, and thats what Sony has and unfortunatly Microsoft dose not.
Sure give this idiot 5 million dollars (him and his lawyer will get most of it) for 2 games that could have gotten scratched for any reason. 3 red lights is a real life defect, but disc drive defects are so rare I would say there's no basis for this BS.
I don't know anyone who has any games scratched by an XBOX 360 console. Some people don't know basic console care, like don't move it while a disc is inside. Is everyone stupid?

the reason people are probably getting scratched discs is not because the system is in a vertical or horizontal position it's probably because they are moving the console with a disc inside. if you read your manual it always says before moving your console you should remove the disc first.
I have two 360's and i haven't had a problem with any scratching.
I have never had any problems with scratching on any consoles except when i moved my ps2 and the disc moved out of position and when it started it made a strange noise and my disc got scratched.
that's probably what's happening to these people because nobody reads thier instruction manuals before operating thier consoles
We didn't move the xbox console while the disc was in use, we take care of our games and we spent a wack of dough buying a system to play the games. I don't want $ from any company, but I really get annoyed when the $ my son and I saved to purchase the system and accompanying games is faulty and resurfacing is unable to solve the problem. The game scratched by our console was Call of Duty 3, no strange noises, just scratched rings. We tried to trade it in but the game stores won't take it due to the scratches. It seems to be a problem with the consoles according to the stores.
I have only had one issue with a scratched disk. I heard a noise albeit a brief one but i noticed a huge chunk of the level i was playing missing when i turned Fenix around. i moved on to the next area and i got a disk read error. so i took out the disk and there was a complete circle gouged into the disk. I didnt touch the 360 i didnt have a fan on, I dont live in an appartment hell i didnt even sneeze. there was no reason it should have gouged it but it did. SO i took the game back to Hollywood video and told them what happened. Good thing i got the $0.25 insurance thing.
the console doesn't have to be on, if the console is moved while a disc is inside on or off can cause damage to the disc.
i'm sure there are cases out there that are legit when it comes to the console scratching the system but i bet the majority is from moving the console while a game disc is still inside the console then turning on the system without opening the tray to make sure the disc is in it's proper place.
When my first 360 died, they sent me a brand new one as a replacement. That one scratched the first disk I put in (having not had this problem ever with the old one). A quick phonecall to MS and Ubisoft (the disk was SCDA) had both the Xbox and the disk replaced free of charge. I don't know how some people approach the Customer Service, but I say being nice to them goes a long way towards having your problem taken care of.
It's NOT FREE. It's $20 to fix a disc damaged by a defect.

Listen, I don't want to come off as a fanboy or whatever because I own all three "next-gen" systems and I enjoy the 360 and the PS3 (not so much the wii) very much but I come on QJ a lot and I can honestly say I've seen a lot more Xbox error and failure stories than PS3 ones.
I think it's sad because microsoft is a good company (and so is sony) and they do promise to build a good system and it's quite horrible that many dedicated gamers out there have their systems fail and break. No, the one guy doesn't deserve 5 million for it but for the class-action? then yeah, that's a definite possibility.
This is why are competitors are failing because they rush their consoles out without thinking first. We as a whole are just waiting for the right moment, as so is Nintendo.
The thing is, is that Microsoft isnt a hardware company so I dont think they would have come up with anything not faulty is they actually put up a different design. Its in the name Micro-Soft(software :D). Maybe in the future they will learn from this and create a better one.
I've had a 360 for about a month.Within the first week my 360 demolished my gears.at the end of the month i had the rings of "death".

I don't think this guy knows what he's in for. if he follows through with this lawsuit he's likely to end up like Roy Pearson. who sued a dry cleaners for damaging his "prized" pants. he sued for $67 million because of "mental suffering, inconvenience and discomfort." well, the judge ruled against Roy and is making HIM pay for over $100,000 in court costs and reimbursements to the defendants.

Ive had my 360 since launch day. Ive never had the red rings, obviously. All my disks look brand new, because I dont move my xbox while its running, and I keep them in a round Multi-CD case with a felt backing. I can't seem to understand why people are having problems. Keep your XBOX well ventilated, ive had the fan stand and intercooler since they came out, and be responsible. The thing cost $400 bucks with a lot more for games and accessories, 4 controllers= Wii, LOL! As for that guy whos sueing, get a *****ing life you whiney *****!

In the lawsuit, the Plaintiff is asking the Court to certify a nationwide class and create a fund for all individuals that have had discs damaged by an Xbox 360. The Plaintiff has alleged that the total minimum amount of damages incurred by all of the individuals combined is at least $5,000,000.00. To be clear, the Plaintiff is not alleging that he or any individual member of the class is entitled to that amount of money.
