and the only games I was playing beforehand were original games... Lame!
It's understandable why MS do this banning but I often ask myself if they are going too far.
The console is purchased and therefore we can as the owner do what we want with it. We can use it as is, give it away or just smash it as a futile protest against MS. Modding is not illegal but it does cancel any warranty obligations from the maker. In this case MS. The live experience is paid for and to remove the service by a banning is not very fair as MS has taken the money.
The modding to allow the playing of a backup I feel is realistic as when I purchase a game and it for any reason ceases to function I have never received money back or a replacement. With my purchase of Overlord it started strange behavoiur at almost the last level and after several attempts to clean as the console stated that the disc was unreadable and maybe dirty it ceased to work. I was then informed that I would have to purchase a new copy as I could not replace what I had even though it was only 10 days old. I get better service from a pair of Shoes.
I have in the recent months done the firmware mod and now only play backups of my games. That I no longer have access to live is
A. bad luck
B. cheaper than repurchasing a game due to scratches or "dirt" ???
I find it totally arrogant that when a maximum number of games sold for any title will never go beyond 100 million copies that the banning procedure is a cheap and negative solution. Any and all games could be produced with a unique registration number and this would inhibit the Piracy problem but allow those owners of the game to have a backup copy. As each console has a unique number and the purchased games also then it would be easy enough to control.
After all they can see what you have played and see what your achievements are and at what level per game played.
As a footnote in the last couple of years I have had 4 discs go bad on me.
Overlord - ??? dirt ?? repurchased for 59 USD
Halo 2 - finally ceased to operate after 14 months of good play. repurchased 15 USD second hand.
Gears of War - bad luck as I dropped the blasted disc and when trying to pick it up of the tile floor it got scratched. repurchased for 40 USD second hand.
TimeShift - got scratched during play ? Sorry MS does not admit to the fact that on occasion discs get sratched. repurchsed for 39.99 USD at a sale.
Total cost 154 USD. Cost of modding, no more live access.
Now before I start my rant I'm going to say I don't take a position for or against piracy. I know it hurts the market if EVERYONE does it but if only one person does it then it's like stealing batteries from a grocery market, they still have all the others to sell so who cares.
The one thing I've always understood (but couldn't find it in writing) is that there are end user license agreements you accept when buying the game system and games. I've always imagine to say "By this purchase, you own the rights to using this machine for it's intended use. You may not alter, modify, reverse engineer, or enhance this product without the consult of the responsible trademarks". I'm sure no such print exists but as I look at all off the cases of these piracy busts they've been doing (including the one from "talk like a pirate day") it seems like they keep mentioning some EULA that prevents the person to modify the system.
As for game backups. It's just an urban legend if you could keep a backup for yourself if you bought a copy. The reason I say that is you don't own the game. I know for a fact that the EULA on a game says that you own a single user license for using the software and that it is not transferable or duplicable. Now sure you can sell it to GameStop and you could make a DVD-DL-R of it but the point I'm getting at is you're breaking the EULA for doing either.
As far as Xbox Live goes, this is a service provided by Microsoft. They reserve the right to change the service and it's access at any time. You paid for the use of the service but it's still owned by Microsoft. It's like paying your bill for cable internet and the internet service "disrupting your service" because you are using Napster (the old illegal one from 1999). They have the right to terminate service if they feel the service is being abused (but who ever reads those long and legal privacy statements and end user license agreements anyways right?)
Again I'm not for or against piracy but I think that everyone should be quiet about their private stock of games and should have a separate system for their backups to play on. If you want to use the same profile, so be it, just do it on a detachable hard drive so you can move the hacked offline system achievements to the unhacked online system then bam! Problem solved.
Oh and based on the sheer luck of shabghai360 damaging 4 of his discs, I think that you all should put your games back in your cases instead of upside down on your entertainment center or in a cd wallet. You wouldn't need a mod to keep you from damaging your games if you were protecting your product.
The best thing you could do for yourself if your system is scratching games is (1) don't move your system while a game is in it (this includes bumping into the entertainment system by accident) (2) Lay the system flat with no incline on either side (use a level if you have to) so the balance of the disc will not be off in the tray and (3) Call Microsoft claiming your system is a "red ring of death" error (see http://sogamer.wordpress.com/ for info on how to fake this) so they will ship you a coffin to ship the system off in (this way you can get the system with the HDMI port on the back which also has a replaced dvd drive that does NOT scratch games with the cd is out of balance in the drive.
I'm not to worried about all of you modders out there, there's enough of you out there that the modding community isn't going anywhere, but the only thing I have to say, you chose to be different than the people who pay for their games, you should be treated different, if not criminal -like, at least like you don't need features that the paying people use. Make your own Xbox Live. Isn't that what X-Link Kai is? Play with your fellow modders. I beat they can cheat better than you can though....

The 360 will time out in system link mode if the ping is greater than 30ms.
This is a deliberate effort to block online play using system link via tunneling.
But really tho, if you have a modded console, you DON'T take it online, very simple.
briefly my comments were to emphasize a particular point.
The cost of games and the use of live. I rarely used the live service but as I no longer receive dash updates it's irritating. I can of course download via the PC.
I made a conscious choice between my games costs and the live costs and use of both.
The xbox disk drives do not have the small rubber protection caps around the lazer as has been proven by the Dutch consumers research body after complaints of scratching.
The drive never runs at a continuous speed so on occasion even when left undisturbed a disk can (on rare occasions) wobble slightly and become unbalanced when the drive suddenly picks up speed to read. If this should occur then your disc is rendered unreadable. Dead and a full price has to be paid for a replacement. Arguments aside this is arrogant and unnaceptable when technolgy is so far advanced that a retail game could have without difficulty a serial number which is then registered to the console. Or better still registered to the users gamer tag. This would inhibit piracy but allow the consumer to make a backup of their property. The way the law works right now it is as if we pay the full price to rent a game, however if the game is for whatever reason unplayable we need to pay the full price a second time for a replacement. The only people that would suffer from this type of registration would be the rental companies and in all honesty rental companies do more financial damage to sales of games than piracy. I state this as most people that really want a game will buy the original. The ability to play a game in a store these days also negates the use of rental to discover if it is a game that you find interesting.
My attitude is more along the lines of where do people or companies draw the line. Are Harley gonna all bikers for customizing their bikes?
Will ford file a lawsuit as you changed the wheels, tampered with the engine etc.
I do not support Piracy but I do not support the attitude that after intense advertising to convince a consumer that the games console is a great way to play that once purchase is made, anything you do with your property (bought and paid for) if the maker is unhappy you get punished.
Sorry if this sounds simplistic but I see it as my basic right.
If they should put in huge letters on the packaging
" you may pay for this product and use it, but if you do anything we do not like we will break it" the product would never sell. People would say What the f***
I have an omelette pan but if i wanna fry fish in it that is my choice and i apologise if i sound arrogant but I regard this as my right. If I should pirate a game for profit then I should be punished.
Why are games so difficult? I have legal software on my computer , I could not reinstall after an upgrade of hardware. I contacted the software company gave them my registration information and they were kind enough to give me a link to download the needed files and also sent me a new copy of the software on a disk. I paid 2.95 usd for a replacement and 3.95 for the post. now that is service. Gamers get ripped which ever way you look at it.
